    Description

    Australians are concerned by wasteful litigation that burdens litigants and the wider community with unnecessary costs. A significant cause of unnecessary litigation in both Australian and foreign jurisdictions is uncertainty about two fundamental legal concepts, factual causation and the scope of liability for the consequences of wrongdoing. This project will build on and enrich the CI's highly influential work on these issues (based on English-language materials) by extending the analysis to the law of several jurisdictions in the non English speaking world. The result will be a conceptual framework of universal validity and value for solving some intractable legal problems.
