Description
This project will be an analysis of the cultural, policy and legal implications of ‘mash ups’. This will include:
*an outline of mash ups, including modern examples such as sound recordings, musical works, film and artistic works, focusing on works seen on You Tube and other online applications;
* a discussion of the historical nature of mash ups with examples from other cultural traditions such as literature, art, and film;
*an analysis of why mash up culture is valuable;
* a consideration of what is limiting mash ups in Australia, focusing on the way in which they are restricted under copyright law;
Part 2:
A model for legislative reform incorporating:
* the position overseas (US, UK, EU, Canada);
* the Lessig framework;
* what a transformative use provision(s) might look like:
* the possibility of a statutory licence;
* options from copyleft, to centrist, to copyright right:
* a discussion of the interaction between economic and moral rights under copyright law
