Description
This research is to inform the development of the Queensland Law Reform Commissions recommendations on particular defences and excuses in the Criminal Code 1899 (Qld). The research will consider:the defence of self-defence (ss 271 and 272)the excuse of provocation for an offence involving an assault (ss 268 and 269) and the partial defence to murder of provocation (s 304) and specifically whether either or both should be repealed or amended;the partial defense of killing for preservation in an abusive domestic relationship (s 304B andthe defense of domestic discipline (s 280).
