Abstract
In recent years, the British government has considered various ways of encouraging shared parenting following divorce or separation. This briefing paper examines whether legislation is an appropriate and helpful mechanism for promoting shared parenting, in particular for cases involving parental conflict. It examines the current legal position on child custody in England and Wales under the Children Act 1989, the extent of shared parenting in the United Kingdom, and current knowledge on the benefits of shared parenting for children. The briefing paper also looks at the introduction of legislation overseas, and includes a case study on the impact of legislation in Australia.
