Abstract
This chapter considers data from the perspective of relational contract theory and Actor Network Theory (ANT). The intention is not to offer a solution to the problem of data use but rather to give a different reading of the relationships involved. The combination of relational contract and ANT with its non-hierarchical view of the relational and horizontal relationships between humans and non-humans gives a more accurate picture of the place data occupies within exchange structures than that offered by more traditional approaches within contract. It allows us to see data as a powerful actor in and of itself and not simply as the by-product of contractual practises and internet use.
