Abstract

This article challenges the prevailing 'legalistic' approach to human rights, where court litigation tends to be considered as the means by which human rights can be enforced. The new human rights legislation in Victoria and the Australian Capital Territory (ACT) - with Western Australia and Tasmania examining the possibilities for legislation - offer broader opportunities for improving the human condition of people on Australian shores.
