Abstract
The discretionary arm of justice has received surprisingly little attention from historians beyond studies of the death penalty's administration. Although historians have considered pardoning and parole within the framework of convict transportation, the broader canvas of the changing nature and forms of discretion that have modified punishment is poorly covered. This chapter responds to that challenge by sketching the debates that have shaped the practices of mercy and parole since the late eighteenth century.
