Abstract
Mass imprisonment without rehabilitation is a major challenge in the US, UK, and elsewhere. The most feasible means of solving it may be to use Common Law powers of constables to defer and delay prosecution, using threat of prosecution as a “Sword of Damocles” to encourage compliance with voluntary rehabilitation programs. This essay describes the rationale for such an approach, the new risk assessment tools it would use, and the experiments that will test it in the UK. If successful, these tests could make offender desistance, rather than prosecution, the principal focus of policing individuals.
